Proposal Argument- Organ Donation of Minors

In 2006, a new legislation was passed in Alberta, Alabama; this legislation concerned the donation of human organs and tissues. This new legislation hoped to bring change concerning the protection of living donation by minors, provisions of quality assurance mechanisms, and confidentiality of health information. As of August 1, 2009, the Human Tissue and Organ Donation Act was proclaimed into effect. Organ donation alone is already a sensitive topic to some as it is faces criticism questioning the ethics surrounding donation; if we add minors into the discussion, you have yourself a larger social and political issue. Should living organ donation be prohibited due to its’ ethical concerns? Relying on organ donation of the deceased alone may not suffice; should organ donation from the living, let alone minors be allowed? The founders of the Human Tissue and Organ Donation Act must have asked themselves these very questions when considering their vote. The organ donation of minors involves three major areas of consideration: its’ ethical concerns, organ shortage all over the world, and how helpful considering this option can be.

High supply and demand for organ donation has drastically risen. A perennial and well-documented problem in organ transplantation is the fact that need for organs far outpaces the supply of organs available for transplantation. Governments seem to continually look for ways to increase the supply of organs, and often zero in on law and practice around consent as a perceived barrier to increased participation in organ donation programs (Nelson, Erin 2010). Is the shortage of organs for donation in our nation enough to open the door for consideration of minors being involved in this process?
